Insurance/Recovery Tip:

Partial Loss? Remember the Clear Line of Sight rule

When dealing with a partial loss, one rule to keep in mind is the "Clear Line of Sight" rule. Here is a good explanation of this rule from a book called The Claim Game by RJ Atherton (pg 140).

"If you have the same carpet throughout the house, you are entitled to replacement throughout the house.  Some adjusters will try to limit the replacement to only the room that has the damage, but don’t go along with it.  If you had perfectly matched carpet throughout the house before your loss, you have a right to the same standard after your loss.

"This principle applies to everything that is subject to repair or replacement – shingles, brick, siding, paint, flooring, windows, wallpaper, etc.  Even if the damage is only to one percent of the total area that has to be replaced, you are entitled to cosmetic consistency.  Don’t accept anything less."

Sempra Energy said Tuesday it is close to reaching a $900 million settlement with insurance companies over the wildfires that burned through the county in 2007.
