Important SDG&E 2007 Wildfire Litigation Update

Community Assisting Recovery, Inc. (CARe) is very pleased to announce a substantial comprehensive settlement has been reached for a group of San Diego County fire victims against SDG&E/SEMPRA in the ongoing litigation regarding the 2007 San Diego fire damages. The group is represented by attorney Brian Heffernan.

Mr. Heffernan’s clients are the only group of whom CARe is aware to achieve a significant comprehensive Witch and Rice Fire award from SDG&E. Mr. Heffernan’s victory reinforces the wisdom of the legal strategies CARe has seen succeed following prior disasters.

Unfortunately, because of opposition by Cox Communications, Guejito Fire losses are yet not settled. The evidence appears to indicate Cox Communications is a potentially responsible party for damages caused by the Guejito Fire. SDG&E, using causation and fire progression maps, has defined Guejito Fire losses to include Escondido, Rancho Bernardo and The Trails. Until causation and “contribution” issues are litigated between Cox Communications and SDG&E, our understanding is no Guejito Fire cases, as defined by SDG&E, will likely be resolved.
