The average homeowners insurance premium rose by 5.7 percent in 2012, following a 7.6 percent increase in 2011, according to a January 2015 study by the National Association of Insurance Commissioners.

When a claim goes south, the insured often pursues a bad faith claim. But even when the bad faith claim settles, that doesn’t always mean the litigation is over. And that means it’s still necessary to be vigilant about preserving the confidentiality of privileged communications. One way that insurers often waive the privilege inadvertently is by making statements during discovery that put the advice of counsel “at issue.”

Here is an interesting question; can a policyholder assign their bad faith claim to someone else? I will discuss several states’ laws on this issue in upcoming posts. Recently the Pennsylvania Supreme Court said yes they can.(1)
